GENERAL TERMS AND CONDITIONS OF THE RENTAL AGREEMENT

All our clients are required to review the rental terms before signing a vehicle rental agreement with us. Below, you’ll find the rental terms provided for your reference.

Article 1 – Authorized Use of the Vehicle

Only individuals over the age of 21 who have held a valid driver’s license for at least 2 years (2 x 365 days) are authorized to operate the vehicle.
The vehicle must not, under any circumstances, be operated in the following cases:
by anyone not listed in the Agreement as the Renter or Driver/Additional Driver,
by anyone under the influence of alcohol, tranquilizers, narcotics, sleeping pills, or other medications,
for paid transport of passengers or goods,
outside the borders of Bosnia and Herzegovina, unless prior written consent has been given by the Lessor,
for participation in sporting events, speed trials, or races,
for pushing or towing any vehicle or object,
when the vehicle is not roadworthy or is overloaded with passengers or luggage,
in violation of legal requirements and regulations regarding the use, loading, or condition of the vehicle, or for any illegal purpose.
These restrictions are not mutually exclusive. Any costs/fines arising from violations of these restrictions will be charged to the Renter, regardless of the insurance coverage. The Lessor bears no liability.

Član 2. – Preuzimanje i vraćanje vozila

The Renter accepts the vehicle in technically sound condition and agrees to return it in the same state, except for normal wear and tear, at the exact time and location specified in the Rental Agreement. The Lessor is not liable for any damages incurred by the Renter due to delays in vehicle delivery. If, for any reason, the vehicle requires special cleaning, the cost will be charged to the Renter.

Article 3 – Rental Extension

If the Renter wishes to extend the rental period, they must notify the Lessor—or the representative who rented them the vehicle—at least one day (24 hours) in advance and sign a new Rental Agreement. Otherwise, it will be considered that the Renter has unlawfully appropriated the vehicle, in which case the Lessor will notify the relevant authorities.

Article 4 – Mileage

The short-term rental agreement includes unlimited mileage. For long-term rentals, the allowed mileage is specified within the agreement.

Article 5 – Fuel

The Renter receives and returns the vehicle with a full fuel tank. Otherwise, the Renter will be charged for the missing fuel up to a full tank according to the Lessor’s current price list.

Article 6 – Vehicle Maintenance

Article 6 – Vehicle Maintenance The Renter is required to treat the rented vehicle with the care of a responsible owner and ensure that the vehicle is always properly locked and windows closed when left unattended, and that the vehicle documents are kept with the Renter (never inside the vehicle).
The Renter must regularly check the engine and oil, as well as the coolant level, battery, and tire pressure. The engine oil must be changed every 10,000 km, exclusively at the Lessor’s service center. The Renter is responsible for any damage caused by improper vehicle maintenance.
If the vehicle reaches the mileage for scheduled servicing during the rental period, the Renter is required to notify the Lessor and bring the vehicle exclusively to the Lessor’s service center. The Renter will not bear the cost of scheduled servicing performed outside the Lessor’s service center if written approval was given.

Article 7 – Breakdowns

All repairs and/or part replacements must be carried out exclusively at the Lessor’s authorized service centers. Otherwise, the Renter will be held liable for any resulting damage.
If any part of the vehicle is replaced without authorization or lost, a compensation fee equal to three times the market value of that part will be charged.
In the event of a breakdown caused by the Renter’s negligence or carelessness, the Renter shall bear the cost of repairs as well as any loss of profit.
If the rented vehicle becomes inoperable due to a breakdown, the Renter is obligated to secure the vehicle against further damage and immediately notify the Lessor.
The Lessor is not liable for any damages incurred by the Renter due to a vehicle malfunction during the rental period. Aside from the modifications specified in this article, the Renter is not authorized to make any other changes to the vehicle.

Article 8 – Documents

The Renter receives the vehicle with all necessary documents. In the event that the Renter loses any of the documents, keys, license plates, etc., they will be additionally charged for the incurred costs according to the Lessor’s price list.

Article 9 – Vehicle Insurance

All vehicles owned by the Lessor are insured for liability for damage caused to third parties.
The insurance does not cover under any circumstances:
any damage caused intentionally or through negligence,
theft, if the Renter does not possess the vehicle’s keys and documentation (especially the registration certificate),
any damage or loss of the vehicle that was not reported to the competent police authority or for which there is no police report,
tire damage,
damage to the vehicle's undercarriage, transmission, and clutch, interior, or windshield caused by driver negligence,
engine damage due to lack of oil, incorrect fuel type, or careless vehicle use,
damage caused by a driver under the influence of alcohol, drugs, or similar intoxicating substances,
damage caused by an unauthorized driver,
any damage to the vehicle not reported to the competent police station.
In all the above cases, the Renter will be held liable for the amount of the damage up to the full value of the vehicle, as well as for any loss of profit caused by the incident.
In the event of any damage, traffic accident, or vehicle theft, the Renter must immediately inform the Lessor and report the incident to the competent police authority.

Article 10 – Passenger Insurance

For an additional daily fee, according to the current insurance price list, passengers are insured up to the policy coverage amount in the event of death or disability resulting from an accident involving the rental vehicle.

Article 11 – Damages

The Renter is liable for any loss or damage to the vehicle caused by intent, negligence, or violation of the Agreement or General Terms and Conditions. The Renter is obligated to compensate for all such damage, including lost profit, up to the full value of the vehicle—unless liability is waived by paying the applicable daily insurance surcharge as specified in the Lessor’s current Insurance Services price list.

Article 12 – Loss of Property

The Lessor is not responsible for any damage to or loss of property belonging to the Renter or other individuals that is stored or transported in or on the rented vehicle, service vehicle, or within the Lessor’s business premises. By signing this agreement, the Renter expressly waives any claims for compensation from the Lessor in the event of such damage or loss.

Article 13 – Subleasing

The Renter is not permitted to sublease or lend the rented vehicle to third parties under any circumstances.

Article 14 – Invoice Payment

Vehicles are rented at a daily rate in accordance with the current price list, where one day represents a 24-hour period from the time the Rental Agreement is signed. Payment must be made by credit card if the Renter is a private individual, unless otherwise approved by the Lessor. Upon signing the Rental Agreement and collecting the vehicle, a credit card pre-authorization is mandatory. If the rental period is not prepaid, the Lessor will charge the rental fee and any additional incurred costs using the credit card slip (completion) at the end of the rental period.
In addition to the rental fee, the Renter is also obligated to pay all other charges incurred under these General Terms, in accordance with the Lessor’s current price list.
By signing this Agreement, the Renter agrees that the Lessor may charge the cost of any repairs, breakdowns, or losses discovered within 24 hours after the vehicle is returned—if not reported by the Renter in accordance with the return procedure—to the Renter’s credit card or via another agreed method of payment. The Lessor is also authorized to charge, in the same way, for any traffic offenses, parking fines, or other penalties incurred during the rental period, including any applicable administrative fees.

Article 15 – Vehicle Inspection and Seizure

The Lessor has the right to inspect any vehicle at any time. If it is determined that the Renter is in violation of any provision of the Agreement or General Terms and Conditions, the Lessor is authorized to seize the vehicle and immediately terminate the Rental Agreement.

Article 16 – Personal Data

Copies of the Renter’s personal documents are a mandatory attachment to the Rental Agreement.
The Renter provides personal data voluntarily, and such data will be used solely for the purposes of the Lessor. The Renter grants permission for their personal data to be used for the Lessor’s marketing activities. The Lessor may request that the Renter leave one of their original documents with the Lessor during the rental period, subject to the Renter’s prior consent.

Article 17 – Amendments and Additions

Amendments and additions to the Agreement and General Terms and Conditions are valid only in written form.
If any provision of these General Terms and Conditions is found to be invalid, it shall not affect the validity or enforceability of the Agreement or the remaining General Terms and Conditions.

Article 18 – Warranties

By signing, the Renter unconditionally accepts the Lessor’s General Terms and Conditions and guarantees compliance with the minimum age requirement for operating a motor vehicle, as well as the accuracy of all provided information. The Renter also agrees to the jurisdiction of the Court in Sarajevo in the event of legal disputes.
By signing the Agreement and General Terms and Conditions, the Renter confirms agreement that the following parties are jointly responsible for covering all costs arising from the Rental Agreement:
The Renter
The Driver – if the Renter refuses to pay all or part of the rental obligations
The Additional Driver – if both the Renter and the Driver refuse to pay all or part of the rental obligations under this agreement
